Apple considered a large investment in Twitter reports the New York Times and Wall Street Journal.

The NYT says Apple was in talks with Twitter 'in recent months' about a strategic investment.

Apple has considered an investment in the hundreds of millions of dollars, one that could value Twitter at more than $10 billion, up from an $8.4 billion valuation last year, these people said. They declined to be named because the discussions were private.

There is no guarantee that the two companies, which are not in negotiations at the moment, will come to an agreement. But the earlier talks are a sign that they may form a stronger partnership amid intensifying competition from the likes of Google and Facebook.

The WSJ has a slightly different report saying that Apple held discussions with Twitter more than a year ago.

Apple Inc. held discussions with Twitter Inc. more than a year ago about taking a strategic investment in the short-messaging service, according to a person familiar with the talks. People familiar with the matter said there are no current formal investment or acquisition discussions between the companies.

Really, CFPB? Indirect Auto Loans?Is That All You Got? | Aite ...

In my 20 or so years in banking, I have seen consumers impacted by horrible, unfair, life-altering events, such as job or home loss or the inability to get health insurance coverage because (wait for it) a consumer could get really sick. Other examples include vicious credit collectors/agencies/law firms, mortgage and HELOC fraud, predatory teaser and adjustable interest rates, automobile title lenders and payday lenders from whom consumers cannot escape, roofing and aluminum siding salesmen pushing loans on the elderly, and on and on. Where I have seen institutions do a credible job of walking the line between lending money and paying for channel delivery services and new customers while allowing the dealer to recover some costs for facilitating the loan has been in indirect automobile finance.

Today, the Consumer Financial Protection Bureau (CFPB) is supposed to protect consumers from the financial services industry in ways that the Federal Trade Commission (FTC) was unable to do. And where do they plan to focus? On ?discriminatory car loans,? says a recent American Banker article ? loans that are purportedly a really big problem. I would argue that this ?problem? is one that most consumers/taxpayers who ?fund the CFPB couldn?t care less about ? a ?problem? that some states, the FTC, and yes, even financial institutions, have worked to purge from the industry. CFPB, if you are going to neglect to regulate or wreak enforcement havoc on the National Association of Securities Dealers and the Securities and Exchange Commission for their failure to protect consumers? 401(k) investments ? particularly since the government forces those funds into the stock market, where many consumers recently lost up to 40% of their retirement savings ? it is painful to see time, effort, and, yes, taxpayer money being wasted on investigating banks (banks that do not see the customer) for discrimination and for adding a minimal servicing fee to car loan interest rates.

I have yet to see the government force any consumer to invest their funds in a car or a loan. Most consumers who go to an auto dealership, find a car they like, and negotiate the purchase are adult consumers more than capable of making adult decisions. The reasons behind financing an auto are obvious. Consumers can get their own loan from any number of sources, or the dealer can help them arrange financing. That many consumers choose dealer-arranged financing is not surprising. Dealer-arranged financing is CONVENIENT.

Busy consumers choose to pay for convenience every day. In this case, they pay to avoid taking time during business hours to go to one or more lender(s) to apply, sign papers, get their check, etc. Balanced against this real waste of time is the half hour it generally takes for the person to get the car when the dealership facilitates the loan. And guess what, CFPB? Consumers are sometimes willingly pay an additional US$150 to US$200 fee to a dealer that supplies ?runners? who head to the state registry with insurance, sales tax, and registration paperwork. So why would they balk at 50 to 300 basis points over the life of the loan? After all, most mortgage brokers take 50 basis points on a mortgage loan and get that paid up front.

The dealer works for the money. For contacting several lenders; getting the loan approved; reviewing bank-generated compliance documents, including contracts, with the consumer; collecting signature(s); and delivering loan paperwork to the lender, a dealer receives a percentage of the interest rate (along with a promise of payment for the car, after which it often waits a month or two for funding). Someone told me once that for the consumer, the difference between an auto dealer and an aluminum siding salesman is freedom of choice. Consumers go to auto dealers, second-mortgage salesman come to consumers? homes. Maybe, CFPB, you might embrace this bit of practicality when choosing your battles.

Officials: Uganda Ebola outbreak kills 14

KAMPALA, Uganda?? The deadly Ebola virus has killed 14 people in western Uganda this month, Ugandan health officials said on Saturday, ending weeks of speculation about the cause of a strange disease that had many people fleeing their homes.

The officials and a World Health Organization representative told a news conference in Kampala Saturday that there is "an outbreak of Ebola" in Uganda.

"Laboratory investigations done at the Uganda Virus Research Institute...have confirmed that the strange disease reported in Kibaale is indeed Ebola hemorrhagic fever," the Ugandan government and WHO said in joint statement.

Kibaale is a district in midwestern Uganda, where people in recent weeks have been troubled by a mysterious illness that seemed to have come from nowhere. Ugandan health officials had been stumped as well, and spent weeks conducting laboratory tests that were at first inconclusive.

On Friday, Joaquim Saweka, the WHO representative in Uganda, told The Associated Press that investigators were "not so sure" it was Ebola, and a Ugandan health official dismissed the possibility of Ebola as merely a rumor. It appears firm evidence of Ebola was clinched overnight.

Health officials told reporters in Kampala that the 14 dead were among 20 reported with the disease. Two of the infected have been isolated for examination by researchers and health officials. A clinical officer and, days later, her 4-month-old baby died from the disease caused by the Ebola virus, officials said.

Officials urged Ugandans to be calm, saying a national emergency taskforce had been set up to stop the disease from spreading far and wide.

There is no cure or vaccine for Ebola, and in Uganda, where in 2000 the disease killed 224 people and left hundreds more traumatized, it resurrects terrible memories. There have been isolated cases since, such as in 2007 when an outbreak of a new strain of Ebola killed at least 37 people in Bundibugyo, a remote district close to the Congolese border, but none as deadly as in 2000.

Ebola, which manifests itself as a hemorrhagic fever, is highly infectious and kills quickly. It was first reported in 1976 in Congo and is named for the river where it was recognized, according to the Centers for Disease Control and Prevention.

A CDC factsheet on Ebola says the disease is "characterized by fever, headache, joint and muscle aches, sore throat, and weakness, followed by diarrhea, vomiting, and stomach pain. A rash, red eyes, hiccups and internal and external bleeding may be seen in some patients."

Scientists don't know the natural reservoir of the virus, but they suspect the first victim in an Ebola outbreak gets infected through contact with an infected animal, such as a monkey.

The virus can be transmitted through direct contact with the blood or secretions of an infected person, or objects that have been contaminated with infected secretions. During communal funerals, for example, when the bereaved come into contact with an Ebola victim, the virus can be contracted, officials said, warning against unnecessary contact with suspected cases of Ebola.

In Kibaale, some villagers had started abandoning their homes in recent weeks to escape what they thought was an illness that had something to do with bad luck, because people were quickly falling ill and dying, and there was no immediate explanation, officials said.

Officials said now that they've verified Ebola in the area they can concentrate on controlling the disease. Ebola patients were being treated at the only major hospital in Kibaale, said Stephen Byaruhanga, the district's health secretary.

"Being a strange disease, we were shocked to learn that it was Ebola," Byaruhanga said. "Our only hope is that in the past when Ebola broke out in other parts of Uganda it was controlled."

The challenge, he said, was retaining the services of all the nurses and doctors who are being asked to risk their lives in order to look after the sick.

"Their lives are at stake," he said.

Officials also worry that other villagers suffering from other diseases might be afraid to visit the hospital for fear of catching Ebola, he said.

Setting Remodeling Expectations | Home Improvement Remodeling ...

Setting the High Mark

Remodeling is complicated and difficult profession to master. Like me, most owners are very involved in our daily businesses. in an effort to stay ahead of the game, I regularly step back and give my processes a tune up especially when remodeling becomes painful.? I liken it to taking a nitroglycerine tablet or spray (in the face of chest pain), it is both therapeutic and diagnostic.

As a remodeling business owner and established practitioner, I need to be working on the present and the future of my business. Occasionally I get very involved with some minutia of project and I lose track of the big picture. In my 7 years now, I have had many successes and the occasional impressive failures. Time and time, again I get a gut check when some unexpected twist pops up, or I let someone down.

This is why there are so many variables in selecting the remodeler for your project. To me, the early phases of remodeling are about setting expectations and selling them. There is no glory in setting unrealistic expectations of price or time for doing the work. Nothing good comes from either.

The goal in my mind is to provide the client with a great project, realistic expectations, and a good value, and make some money for our time, hard work, and expertise.

Yikes.

Although these are simple and noble goals, there are so many tight turns and slippery slopes to navigate. Once a project is in process it is easy to get derailed. The bigger the project, the higher the risk.
Here are the results of my recent tinkering.

Ways I manage expectations:

• I have broken the Design Phase into 2 parts
  • Schematic Design
  • Design Development
• I have a great set plans created with elevations, and an electrical plan created to make sure we stay on the same page.
• I create a? very detailed room by room, wall by wall Description of Work DOW.
• I regularly adjust the ?Opinion of Probable Cost? with changes of scope, and selections of materials
• I have bids on everything over $300
• I have the experience to know how long it takes to do different phases of construction.
• I know what it cost to run my company.

Ways I mitigate risk:

• I have each subcontractor walk through prior to doing the work and providing a bid.
• I have the project manager understand the project by heart.
• I have a schedule all the way to the end before we start.
• I have a group of employees and subcontractors that believe in me and the company.
• I have an excellent communication platform that is second to none.
• We use checklists to verify that we are sticking with the plan.

The Pit

Skipping these safety precautions, is like driving recklessly without a seat belt. In other words, we are putting a lot of folks at risk. An example of this is in the movie Money Pit, when the contractor is asked how long it is going to take, the stereotypical response is, ?2 weeks.? I ask my staff rhetorically, ?In whose best interest is it to spout unrealistic expectations??

Sure, we bend the rules at Levco when something happens that is out of the ordinary. Each time we improve the process of remodeling with us. The next time an unusual situation crops up (and they always do) we will be better prepared to react.

Each time I sign a Design or Remodeling Agreement I take a moment to pause and confirm in my mind that what I say is what I can produce. Promising to do something in a given time for a stated price is a huge responsibility that I do not take lightly. After all I am being trusted to tear apart a home and put it back together for real money.

1. Clear communications + Plans + Specifications + Bid = Realistic expectations.
2. Realistic expectations + Engaged, knowledgeable project manager + Great subcontractors= Great Project
3. Great Project + Happy Clients = More referrals.

NEW YORK (AP) ? Whether they think the mayor is combating obesity or infringing on their rights, New Yorkers are scheduled to get their say on a proposed ban on large sugary drinks served at restaurants, movie theaters and other eateries.

Mayor Michael Bloomberg said Monday that "sugary drink consumption is a key driver of the obesity epidemic," and an estimated 5,800 New Yorkers will die this year because they're obese or overweight.

Meanwhile, about an hour later more than 100 people gathered on the steps of City Hall to protest the proposed ban.

The proposal requires only the approval of the Bloomberg-appointed Board of Health to take effect, although opponents could still sue to block the ban, or they could convince legislators to step in. A public hearing is scheduled for Tuesday.

Book publishers hunt online for the new EL James

Mainstream publishing houses are colonising fresh territory in the next stage of an ebook revolution that is changing not only how we read, but what we read, for ever.

Following the success of Fifty Shades of Grey, which started out as an ebook series posted on a fan site by author EL James and has become the world?s fastest-selling book, publishers are starting to move in on the profits generated by the thriving online platforms that serve unpublished writers.

Last week Pearson, the owner of Penguin Books, bought one of the largest grassroots publishers, Author Solutions, based in Indiana, in the US, for ?74m. The idea is that Pearson will no longer have to rely on spotting ebook hits early; instead, they will own a new author?s work from the first moment it appears on screen. This acquisition comes in the wake of Pearson?s launch last year of Book Country, a website on which fiction authors could publish their work.

Last Thursday Glaswegian author Denise Mina said she believed the power of the ebook would soon alter the way authors set about writing fiction. Speaking as she received the Crime Novel of the Year award for The End of the Wasp Season at a ceremony in Harrogate, Yorkshire, she said: ?Nobody knows what sells. More so now because the market?s changing so fundamentally because of Kindle and electronic publishing. With literary production, it?s going to change the sorts of stories that we hear, which is amazing.?

She added that she expected publishing norms ? such as the average book length of 350 pages ? to be further broken down. While Charles Dickens shaped his stories to appear as serialised instalments, so ebook authors will be increasingly free to play with form and length at will.

?Why is that a story? Why isn?t a story 18 pages or 150 pages, which isn?t a novella and it isn?t a novel? But it can be now, on electronic media,? she said.

The writer also predicted that many of the ?bottlenecks? that prevent some writers being published will disappear. ?The class divide is going to change. A lot more working-class people are going to get published,? she said.

RottenTomatoes.com has suspended user comments on a film for the first time following a fan uproar after two critics posted negative reviews of "The Dark Knight Rises"?on Monday.?

The review-aggregating site rates films by a percentile approval rating. As of Wednesday morning, "The Dark Knight Rises" stood with a 94% approval from critics and 96% "fresh" rating from the audience. But?two reviews appear to have set fans off: Marshall Fine of?Hollywood and Fine?wrote that the film was "grandiose not grand," and the?Associated Press'?Christy Lemire said that the film "lacked the spark that gave 2008's 'The Dark Knight' such vibrancy."

"The Dark Knight Rises" is already stirring controversy, and very few people have even seen it.

The backlash overwhelmed the site, said Rotten Tomatoes editor-in-chief Matt Atchity, who told the AP that "it just got to be too much hate based on reactions to reviews of movies that people hadn't even seen."

In a post on the site?titled "This Is Why We Can't Have Nice Things," Atchity explained his reasoning behind shutting down comments for the film: "As expected, we saw a mountain of comments come in about (Fine's) review, and we're policing them to make sure they're in line with our (terms of service). Broadly speaking, threats and hate speech will get your commenting privileges revoked.

"But Marshall has the right to not like the movie, and people have the right to express their disagreement with him (although if you haven't seen the movie, your arguments may be on shaky ground)," Atchity wrote. "And we have the right to pull your comment down and ban you if we think you're acting inappropriately."

Warner Bros. is both the studio for "The Dark Knight Rises" and the owner of Rotten Tomatoes (via Flixster.com), but there is no indication that the company asked Atchity to take action.

In a second twist, critic Eric D. Snider posted a review for "Dark Knight" which pranked?many readers. He began with negative comments about the film, calling it "easily the most disappointing Batman film so far," then wrote "just kidding." Snider chose to post the opening sentences as his Rotten Tomatoes tease, knowing fans would see only the negative lines and get upset. Snider hadn't actually seen the film yet,? Atchity wrote, also berating the critic for linking the review to his personal site while listing Film.com in the Rotten Tomatoes teaser.

"This is not the first time he's done this, nor is it the first time his journalistic ethics have been brought into question," said Atchity, who added that Snider's reviews would "no longer apply to the Tomatometer."

Atchity told The New York Times that commenting is likely to start up again later this week, but that site editors?are looking at other options to prevent this from happening in the future -- perhaps even as soon as the December release of "The Hobbit: An Unexpected Journey," another strongly anticipated film with a large, passionate fandom.

He noted that the site may decide to end the practice of letting anonymous users comment on reviews, or take away the comment function entirely.

"It's within the realm of possibility," he said. "I'm not sure that's page views we really want."

It appeared to be a rare Arab Spring setback for Islamists, who won elections in Egypt and Tunisia ? but the structure of the parliament, heavy with independent members, left the final outcome uncertain.

The election is a major step for a country emerging from 42 years of Moammar Gadhafi's one-man rule. It also marks the end for the interim National Transitional Council, which has been running?Libya?with varying degrees of success since Gadhafi was overthrown and killed last year.

The election commission said former interim Prime Minister Mahmoud Jibril's National Forces Alliance won 39 seats, or nearly half of those allocated for parties.

The Muslim Brotherhood's Justice and Construction party came in second with 17 seats. Smaller factions won the other 24 seats set aside for parties.

Only one woman won a seat as an independent, according to the final results announced late Tuesday in the capital, Tripoli. Unofficial returns showed about 33 women winning seats in the parties section.

In a surprise result, the Islamist National Party, led by ex-jihadist and former rebel commander Abdel-Hakim Belhaj, won no seats.

The balance of power lies with the 120 seats set aside for independent candidates, some of whom are likely affiliated unofficially with parties.

The 200-seat National Assembly will be tasked with forming a new government to replace the NTC's Cabinet.

An early test will be a decision on whether to uphold a decree by the NTC for another election to select a 60-member panel to write a new constitution ? or revert to the original plan and choose the panel itself.

The power brokering began even before the official results were announced.

Jibril's alliance and Islamists, led by the Muslim Brotherhood, are competing for the allegiances of independent candidates, hoping to bring them into ruling coalitions.

Jibril's alliance beat Islamist parties by tens of thousands of votes, most notably in the country's two largest cities, Tripoli and Benghazi.

Analysts say that Libyans looking for a strong figure to lead the country saw in Jibril a recognizable face. He was a senior official and economist in the former regime before joining the uprising, where he served as the interim prime minister for almost eight months. He was not a candidate for parliament himself because election laws banned members of the NTC from running.

Millions of South African children wish Mandela happy birthday

JOHANNESBURG (AP) ? Nearly 12 million children across South Africa kicked off celebrations Wednesday for the 94th birthday of Nelson Mandela, the country's deeply loved anti-apartheid icon, with resounding choruses of Happy Birthday.

Mandela is expected to spend the day privately with his family at their homestead in his southeastern birth village of Qunu. Meanwhile, communities in South Africa and around the world were dedicating 67 minutes of the day to volunteer work and projects for the needy ? one minute to mark each of Mandela's 67 years in public service.

Mandela became South Africa's first black president in 1994 after spending 27 years in prison for his fight against racist apartheid rule, and was awarded a Nobel Peace Prize for his efforts.

Tributes to Mandela poured in early Wednesday, with U.S. President Barack Obama saying Mandela "has changed the arc of history, transforming his country, the continent and the world."

Ahmed Kathrada, one of Mandela's oldest friends, said Madiba, as he is affectionately known by his Xhosa clan name, championed the dignity of all.

"You can be rich but if you don't have dignity you are a second-class citizen," Kathrada said in a public lecture marking the birthday celebrations.

Tokyo Sexwale, a longtime ally in the governing African Nation Congress, described Mandela as a global statesman who inspired the world.

At one Johannesburg elementary school Wednesday, children watched a film documenting Mandela's life and his years of service and sacrifice along with a photographic display of him meeting celebrities including Beyonce, Michael Jackson and Cristiano Ronaldo.

"Nelson Mandela set an example to show us that reconciliation is possible," said 10-year-old Thakgalo Ditabe. She said she wanted Mandela to know how much he meant to her.

Ntando Ntuli, 12, said with pride: "He is my hero because he fought for us. He is an icon, the king of Africa."

In 2009, the United Nations established Nelson Mandela International Day to honor the African leader on his birthday through acts of community service.

In many districts, South Africa came to a virtual standstill early Wednesday as strangers greeted each other in the streets and even infants at one pre-school waved at passersby and sang: "We love you, Tata," or "great father," a supreme term of endearment.

In the eastern port city of Durban Sir Alex Ferguson, manager of England's Manchester United football team that is widely followed in Africa, sang Happy Birthday over a cake iced with the image of the team's yellow and red badge.

Ferguson, who met Mandela on previous visits, said "his presence and personality exudes all around."

Manchester United plays the first game of its South African tour later Wednesday.

South African churchmen and politicians urged people across the country "to make every day a Mandela Day."

Former U.S. President Bill Clinton got the celebrations off to an early start Tuesday. He and daughter Chelsea met with Mandela in Qunu. Photographs tweeted by one of Mandela's grandsons showed the Nobel Peace Prize winner comfortably seated in an armchair with a blanket over his knees and with the Clintons and his wife, Graca Machel, at his side.

Nobel laureate Archbishop Emeritus Desmond Tutu said the greatest gift the nation could give Mandela on Wednesday would be "to emulate his magnanimity and grace."

"Mr. Mandela taught us to love ourselves, to love one another and to love our country," Tutu said.

Mandela's activism helped bring democracy and freedom to the once white-ruled South Africa. But the country remains beset by tensions over continued white minority domination of the economy, massive unemployment, poor education and health services and the millions who remain homeless or in shacks
